 James BurkeUseful paragraph re: value of a software patent - "I am often asked whether patent protection is a feasible option for protecting software. Patent protection under English law does not usually apply to software, although there are some exceptions to this rule. The underlying source code, together with any web content, is protected under copyright provisions, as discussed above. In order for patent protection to apply, the software must bring about a technical effect which goes beyond the operation of the software itself. Whilst a number of cases have passed through the courts where patents have been granted, such instances are few and far between and businesses should not, therefore, seek to rely on patent protection."
